These Terms of Service ("Terms") govern your use of the AwardEdge platform operated by AwardEdge ("we", "us", "our"). By accessing or using our service, you agree to be bound by these Terms.

1. Service Description

AwardEdge provides bid prediction and contractor intelligence tools for public construction contracts. Our platform analyzes publicly available DOT letting data, bid history, and contractor records to generate predictions and analytics.

2. Account Registration

To access predictions and premium features, you must create an account with accurate information. You are responsible for maintaining the security of your account credentials and API key. Notify us immediately of any unauthorized access.

3. Subscription & Billing

• Free Tier: Limited access to browse contracts and view basic information at no cost.
• Pro Tier: Full access to predictions, scoring, and contractor intelligence. Billed monthly via Stripe. Cancel anytime — access continues through the end of your billing period.
• Enterprise: Custom pricing for multi-user teams. Contact us for details.

All prices are in USD. We may change pricing with 30 days' notice to existing subscribers.

4. Acceptable Use

You agree not to:

• Share your API key or account access with unauthorized users
• Scrape, resell, or redistribute our predictions or data in bulk
• Attempt to reverse-engineer our prediction models
• Use the service for any unlawful purpose
• Exceed reasonable usage limits or abuse the API

5. Predictions Disclaimer

AwardEdge predictions are informational tools, not guarantees. Our models analyze historical patterns to generate statistical estimates. Actual bid results may differ significantly from predictions. You should not rely solely on our predictions for bidding decisions.

We make no warranty that predictions will be accurate, complete, or timely. Construction bidding involves many factors beyond the scope of any predictive model.

6. Data & Intellectual Property

Our prediction models, algorithms, analytics, and platform design are proprietary. The underlying DOT contract data is public record.

You retain ownership of any data you provide (company info, preferences). We retain ownership of predictions, scores, and analytics generated by our platform.

7. Limitation of Liability

To the maximum extent permitted by law, AwardEdge shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the service, including but not limited to lost profits, lost bids, or business interruption.

Our total liability for any claim shall not exceed the amount you paid us in the 12 months preceding the claim.

8. Service Availability

We strive for high availability but do not guarantee uninterrupted service. We may perform maintenance, updates, or modifications that temporarily affect access. We will provide reasonable notice for planned downtime when possible.

9. Termination

You may cancel your account at any time. We may suspend or terminate accounts that violate these Terms. Upon termination, your access to the platform ceases, but we may retain anonymized usage data for improving our services.

10. Changes to Terms

We may modify these Terms with 30 days' notice to registered users. Continued use after changes take effect constitutes acceptance of the updated Terms.

11. Governing Law

These Terms are governed by the laws of the Commonwealth of Massachusetts, USA, without regard to conflict of law principles.
